BOOKING TERMS AND CONDITIONS

Fisheye Journeys Travel Company is defined to include its owners, agents, directors, officers, employees, representatives, and affiliates, (collectively “Fisheye Journeys”). By booking a trip with us, you are agreeing to these Booking Terms & Conditions, which constitutes the entire agreement between you and us. 

TRIP CONFIRMATION AND PAYMENT DETAILS

Fisheye Journeys accepts credit cards as acceptable methods of payment. We will send you a confirmation e-mail of receipt of payment and a welcome packet with details about the trip you have booked. 

TRAVEL INSURANCE

Travel insurance is mandatory for all of Fisheye Journeys’ travelers, and must be purchased within 3 days of initial trip deposit. Proof of said insurance must be provided within 3 days of initial trip booking. Travel insurance must provide coverage against personal accident, death, medical expenses, and emergency repatriation with a minimum recommended coverage of 100,000 USD in personal injury and 200,000 USD in repatriation and evacuation expenses. It is strongly recommended that you purchase “Cancel for Any Reason Travel Insurance” as this type of coverage covers offers travelers the most cancellation flexibility. This benefit is time sensitive and has other eligibility requirements. Trip cancellation insurance may be the only means of receiving reimbursement for flights and other non-refundable expenses should your trip with Fisheye Journeys be cancelled for any reason. It is your responsibility to verify your insurance policy details with your insurance provider to ensure Fisheye Journeys’ requirements are satisfied. 

DEPOSIT REQUIREMENT

At time of booking, a non-refundable deposit of 500 USD per person, per trip is due. If booking is made 45 days or less prior to departure, full payment is due. 

FINAL PAYMENT REQUIREMENT

Payment of the balance of the trip price is due 45 days before departure. If payment is not received by the due date, rates and trip space cannot be guaranteed. If a trip is booked 45 days or less before the departure date, then the full amount is payable at the time of booking.

For no additional fee, we will break up your balance into two payments. After your deposit and initial payment, the remainder of your balance is due 45 days before the date of your trip. If you choose not to select the payment plan, you will first submit the deposit to secure your spot, and then we will send you an invoice for the remainder amount, also due 45 days before the date of your trip.

CANCELLATION BY THE TRAVELER

Any cancellation by you must be made in writing and must be acknowledged by Fisheye Journeys in writing. The date on which the request to cancel is received by Fisheye Journeys or its Agents will determine the cancellation policy applicable.

  • Cancellation 30 days or less before departure: 100% of total booking cost, including Deposit, held by Fisheye Journeys.

  • Cancellation 31 days or more before departure: deposit held by Fisheye Journeys plus any expenses incurred by the ground operator.

CANCELLATION BY US

Should Fisheye Journeys deem it necessary to cancel the scheduled trip after payments from the traveler have been received, payment will be refunded or applied towards a future Fisheye Journeys trip. *This does not apply to Custom Travel* In circumstances where the cancellation is due to external events outside our reasonable control, refunds will not include any unrecoverable costs. We are not responsible for any incidental expenses that you may have incurred as a result of your booking, including, but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.

Cancellation in regard to the COVID-19 outbreak and force majeure

Should the trip be cancelled due to force majeure, for example: a natural disaster, pandemic, endemic, civil unrest, government intervention or health organization that influences travel, war, or other reason that prevents us from fulfilling a trip, 100% of the costs paid by you will be held by Fisheye Journeys and converted into a non-expiring credit to be used on a future Fisheye Journeys group trip. The credit cannot be used to cover expenses for private trip. Cancel for Any Reason insurance may be the only way to get a refund back on the payments made by you.

TRIP & ITINERARY CHANGES

Our trip prices are subject to variable and seasonal pricing. Advertised prices are based on current rates of exchange, tariffs, and taxes. Fisheye Journeys reserves the right to increase its trip price without notice to cover increased costs, tariffs, and taxes. Every effort will be made to operate trips as planned, but alterations may occur after the final itinerary has been issued.

YOUR INFORMATION

In order to for us to confirm your travel arrangements, you must provide all requested details including legal name, date of birth, passport number, passport issue and expiry date. Your booking cannot be confirmed without these details.

INCLUSIONS

The land price of your trip includes: 

  • All accommodation as listed in the Itinerary

  • All transport as listed in the Itinerary

  • Sightseeing, activities, and meals listed in the Itinerary

Please note that if any meals, activities, or transportation are missed due to the traveler separating from the group for any reason, the cost of that meal, activity, or transportation will not be refunded or credited to the traveler.

EXCLUSIONS

The land price of your trip does not include: 

  • International flights or internal flights unless specified

  • Taxes and excess baggage fee charges unless specified

  • Meals other than those specified in the Itinerary

  • Visa and passport fees

  • Travel insurance

  • Optional activities and all personal expenses

DISCOUNTS & PROMOTIONS

All discounts and reduced pricing are applied at Fisheye Journeys’ discretion. The reduced pricing applies to new bookings only. Any reduced pricing or discounts that may become available after you have paid your deposit are locked into their original price and will not apply. 

AGE & HEALTH REQUIREMENTS

All travelers must be 18 years of age or older unless they are accompanied by a legal guardian, or in lieu of a legal guardian, by an escort over the age of 18, appointed by their legal guardian. The legal guardian or their designee will be responsible for the traveller under the age of 18 day to day’s care. If a legal guardian elects to designate an escort in their lieu, they will be required to complete and sign a relevant document, to delegate their authority. 

It is your responsibility to ensure that you obtain proper and detailed medical advice at least two months prior to travel for the latest health requirements and recommendations for your destination. 

OPTIONAL ACTIVITIES

During any Fisheye Journeys trip, there may be opportunities to participate in activities or local events, which are not included in Fisheye Journeys’ packaged trip. Fisheye Journeys makes no representations about the safety or quality of these activities and events, or the standard of the independent operator running it. You accept that any assistance given by your group leader or local representative in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and activity provider.

PASSPORT & VISAS

Passports are required for travel to most destinations. Please check with the appropriate consulate or embassy for the latest visa requirements. Your passport must be valid for 6 months beyond the duration of your trip. It is your responsibility to ensure that you are in possession of the correct visas, permits, and certificates for your trip. We are not responsible if you are refused entry to a country because you lack the correct passport, visa, or other travel documentation. 

TRANSPORTATION POLICY

To ensure the safety of our Travelers and staff, we ask that you adhere to the following: 

  • Wear your seat belt at all times while riding in any vehicle that is in motion. It is noted that seat belts are not readily available on all of the transportation we take, on either charter or public vehicles. Where available, we expect our travelers to use them. We cannot be expected to constantly monitor everyone to make sure everyone is buckled in at all times. Therefore, it is your responsibility to wear your seat belt properly and at all times while the vehicle is in motion.

  • Public buses are a common mode of transportation on Fisheye Journeys trips, and on occasion local buses can be very crowded, with people standing in the isles. On rare occasions, Fisheye Journeys travelers may not have access to a seat and will stand, but this period should not be excessive and other transport arrangements will be made if there is simply no room on the bus. We rely on public transport providers to maintain the vehicles we use in a roadworthy condition, but we do not perform independent tests on public vehicles. If, in the group leaders opinion, the vehicle is unsafe then alternative transport arrangements will be made.

ACCEPTANCE OF RISK & WAIVER

You are responsible for purchasing the style of trip that fits your desired comfort level and participating in activities that are suitable for your fitness level and capabilities. By making a booking, you acknowledge that Fisheye Journeys’ trips are adventurous by nature and may involve a significant amount of personal risk. You are aware that travels such as those which you are undertaking involve hazardous activities, some in remote areas of the world, with a risk of injury or death which may be caused by forces of nature, the negligence of Fisheye Journeys, or other persons and companies known or unknown, or of willful or criminal conduct of third parties. You are also aware that medical services or facilities may not be readily available or accessible during some or all of the time during which you are participating in this trip. 

You accept these risks and obligations and fully assume the risks of travel and work in this type of environment. You fully and forever release and discharge Fisheye Journeys and all other related, affiliated, associated or otherwise connected corporations, partnerships, individuals and other entities and all of their respective officers, directors, employees, contractors, agents, successors and assigns (collectively, the “Releasees”) from any and all costs (including, without limitation, actual legal costs), claims, demands, actions, causes of action and liabilities whatsoever for any and all losses, damages, death or injuries to persons or loss of property, which may be sustained by you in connection with or in any way relating to this trip, due to any cause or reason whatsoever including, without limitation, the reckless, willful or negligent actions or omissions of the Releasees or any other person or persons. 

PERSONAL RESPONSIBILITY

You acknowledge that neither you nor anyone traveling with you has any physical, mental, or other conditions or disabilities that would create a hazard to yourself or your group members. Fisheye Journeys reserves the right to decline anyone from joining a trip with justifiable cause. Fisheye Journeys also reserves the right to remove you from a trip if you are creating a hazard to yourself or others, impacting the enjoyment of others, or participating in any illegal activity. Any costs resulting from being removed from a trip or being declined participation in a trip is at your expense.

TRAVEL ADVISORIES & WARNINGS

The safety of our travelers, leaders, and operators is a major priority of Fisheye Journeys. With this in mind we monitor world events very closely. Fisheye Journeys makes operational decisions based on informed advice from a number of sources. Although we continually monitor the areas we visit, it is your responsibility to stay informed about the areas where you will be traveling to including any travel advisories and warnings issued by the U.S. State Department. Visit their travel website at www.travel.state.gov or contact them by phone at 1-888-407-4747. You are responsible for protecting your own well-being and personal property before, during, and after your Fisheye Journeys trip. This includes ensuring any and all vaccinations, inoculations, or prescribed medications are taken as directed by your local doctor and/or travel clinic for the areas visited.

LIABILITY RELEASE

Fisheye Journeys does not own or operate any entity which is to or does provide goods or services for your trip including, for example, ownership or control over hotels or other lodging facilities airline, vessel, bus, van, or other transportation companies, local ground operators, providers or organizers of optional excursions, food service or entertainment providers, etc. Fisheye Journeys is not responsible for any injury, loss, or damage to person or property, death, delay or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to, acts of nature, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, structural or other defective conditions in hotels or other lodging facilities, mechanical or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely, dangers associated with animals, marine life or vegetation of any sort, dangers incident to recreational activities such as scuba diving, snorkeling, swimming, kayaking, sailing, canoeing, rafting, hiking, bicycling, rock climbing, etc., sanitation problems, food poisoning, lack of, access to or quality of medical care, difficulty in evacuation in case of medical or other emergency, or for any other cause beyond the direct control of Fisheye Journeys. 

CLAIMS & COMPLAINTS

If you have a complaint about your trip please inform your group leader or our local representative immediately in order that they can attempt to rectify the matter. If satisfaction is not reached through these means then any further complaint should be put in writing to us within 30 days of the end of the tour. Any and all supporting documentation to the claim or complaint must accompany the written letter or e-mail. 

MEDIA RELEASE

You hereby consent and agree that Fisheye Journeys, it’s employees, officers, and agents reserve the right to take photographs, videotape, or digital recordings of you from any Fisheye Journeys trip/event/activity and to use these in any and all media, now or hereafter known, and exclusively for the use of Fisheye Journeys. You further consent that your name and identity may be revealed therein or by any descriptive text or commentary.

You do hereby release to Fisheye Journeys, its agents, and all employees all rights to exhibit this work in print and electronic form publicly or privately and to market and sell copies. You waive any rights, claims, or interest you may have to control the use of your identity or likeness in whatever media used. 

You understand that there will be no financial or other remuneration for recording you, either for initial or subsequent transmission or playback.

PRIVACY POLICY

Any personal information that we collect about you may be used for any purpose associated with the operation of a trip or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate the trip.  We will otherwise treat your details in accordance with our privacy policy (available for viewing on our Website).

APPLICABLE LAW

The laws of the State of Texas govern these Booking Terms & Conditions to the fullest extent allowable. Any disputes in connection with a trip or these Booking Terms & Conditions must be initiated in the courts of the State of Texas. 

UPDATING BOOKING TERMS & CONDITIONS

Fisheye Journeys reserves the right to update and/or alter these Booking Terms & Conditions at anytime, and it is the Travelers responsibility to be familiar with them. The latest Booking Terms & Conditions can always be found on the Fisheye Journeys website www.fisheyejourneys.com and will supersede any previous versions.
